- User Obligations
When using these services, you undertake not to use them for any illegal purpose or in any unlawful manner, and you agree to comply with the laws of the Republic of China (Taiwan) and all international Internet practices. You also guarantee not to use TEASTRUCK to engage in any conduct that infringes upon others’ rights or violates the law, and you must comply with the following rules.
- Do not impersonate another person when using TEASTRUCK services.
- Do not use programs or other methods to automatically and massively apply for or collect TEASTRUCK files for advertising or for sending advertising materials.
- Do not use programs or other methods to interfere with the normal operation or transmission of the service system, or to distribute computer viruses.
- Any other conduct that the Company has legitimate reasons to deem inappropriate is prohibited.
- Registration Obligations and Account Security
- When applying for membership, please provide true, accurate, complete, and up-to-date personal information.
- You must not provide any false, inaccurate, outdated, incomplete, or misleading information.
- If any of the personal information you provided at registration changes in whole or in part, please update it promptly to ensure compliance with the above requirements.
- Member account or password information must not be disclosed, transferred, gifted, rented, or lent to others.
- Without proper justification and the website’s prior written consent, members may not share their accounts with others.
- If your account is stolen or misused by a third party, you must immediately notify the website and follow the steps it specifies.
Members are responsible for maintaining the confidentiality and security of their account and password. Any losses arising from poor management or negligence regarding the account or password shall be borne by the member.
- Transaction Guidelines
- The quantities of products offered by TEASTRUCK are limited. Please complete the ordering process promptly after selection. Placing items in the shopping cart does not mean the order is complete. If another user completes an order before you finish, that user has priority for shipment. If the item is sold out as a result, please remove it from your cart.
- You may place orders according to the Company’s mechanism for confirming product quantities and prices. Unless the Company rejects your order with legitimate reasons within two business days after submission, the transaction is deemed established.
- TEASTRUCK may set a purchase limit per order for specific products. If you exceed the limit or place repeated or multiple orders using multiple accounts, the Company is only responsible for fulfilling up to the per-consumer limit.
- Delivery will follow the method you select at checkout. Product prices do not include shipping. However, if you meet specific promotional conditions, shipping may be borne by the Company based on your chosen delivery method. If abnormal returns increase logistics costs, the Company will deduct the additional logistics fees from your refund (shipping fees follow the announcement at the time of order).
- Pursuant to Article 19 of the Consumer Protection Act, you may exercise your right to cancel the contract within seven days after receipt of the goods. For matters not otherwise specified regarding shopping, the relevant rules apply.
- Protection of Intellectual Property Rights
- All software or programs used by TEASTRUCK and all content on the website—including but not limited to trademarks, works, images, files, information, data, model photos, product photography, illustrations, website architecture, programming, page arrangement, layouts, and other marks or information—are legally owned by TEASTRUCK or other rights holders, and are protected by the Copyright Act, Trademark Act, Patent Act, Trade Secrets Act, Fair Trade Act, and other laws. No one may use, modify, reproduce, publicly broadcast, adapt, distribute, publish, reverse engineer, decompile, or disassemble any of the foregoing without prior written consent. To quote or reproduce such software, programs, or website content, you must first obtain the prior written consent of TEASTRUCK or the relevant rights holder, to avoid infringement or violation.
- The TEASTRUCK trademarks, service marks, and product/service names (collectively, “Trademark Information”) are operated by the Company. Without the Company’s prior written consent, you agree not to display, use, or otherwise process the Company’s Trademark Information in any way, nor indicate that you have any right to display, use, or otherwise process such Trademark Information.
- Limitation of Liability
You agree that, for any dispute arising from your use of TEASTRUCK or purchases made thereon, except where otherwise mandatorily required by law, the maximum liability shall be three times the amount you actually paid to the Company for the relevant use or purchase. However, for any loss, liability, cost, expense, and disbursement—including reasonable attorneys’ fees—incurred by the Company due to your violation of the Terms of Use or due to information you provide or actions you take, you shall fully indemnify the Company.
- Service Termination and Disclaimer
- The Company will use security methods and technologies reasonably expected at present to maintain normal operation of TEASTRUCK. In the following circumstances, the Company may suspend all or part of the services without prior notice and shall bear no liability for any direct or indirect damages arising therefrom:
- Relocation, replacement, upgrading, maintenance, or repair of relevant software or hardware for TEASTRUCK.
- Service stoppage or interruption caused by natural disasters or other force majeure.
- Service stoppage or interruption due to telecommunications or website providers or for other reasons not attributable to the Company.
- External interference causing incorrect information display, forgery, tampering, deletion, or interception, or causing system interruption or abnormal operation.
- Suspension or termination of services to users who violate the Terms of Use or laws.
- Other circumstances where the Company deems suspension or termination necessary.
For foreseeable maintenance plans that may cause service suspension or termination, the Company will, where possible, make an appropriate announcement on the TEASTRUCK pages in advance.
- The Company provides no express or implied warranties for TEASTRUCK services, including but not limited to merchantability, particular quality, or non-infringement. You bear all risks of using the services. The Company does not guarantee:
- That TEASTRUCK will fully meet your requirements.
- That services will be uninterrupted, timely, secure, reliable, or error-free.
- That results obtained via TEASTRUCK will be absolutely correct and reliable.
- That any products, services, or information you purchase or obtain via TEASTRUCK will meet your expectations.
- That any software errors will be corrected.
- Whether to use or download any data via TEASTRUCK is at your own discretion and risk. Any damage to your computer system or data loss resulting from downloads shall be borne by you and is unrelated to TEASTRUCK.
- Any advice or information obtained from TEASTRUCK, whether written or oral, does not constitute any warranty beyond what is expressly stated in the Terms of Use.
- For causes beyond the control of TEASTRUCK—including but not limited to natural disasters, wars or terrorism, natural calamities, fees levied pursuant to laws and policies, and shortages of goods and services—delays in shipment or failure to perform may occur. In cases where undelivered items are canceled due to such causes, TEASTRUCK will refund the corresponding payment to the customer.
- Information on items, personal data, images, etc. uploaded by users is solely the users’ responsibility. TEASTRUCK bears no responsibility for the truthfulness or completeness of such content.
- TEASTRUCK is not responsible for data damage, loss, theft, or alteration caused by force majeure that affects normal Internet operations, including but not limited to virus intrusion or outbreaks or temporary shutdowns due to government regulation.
- Any false or illegal information posted by users via TEASTRUCK, or any infringement of others’ rights, fraud, or extortion is individual behavior; TEASTRUCK bears no responsibility for disputes arising therefrom.
- Governing Law and Jurisdiction
If any clause of the TEASTRUCK Terms of Use is invalid in whole or in part, the validity of the remaining provisions is not affected. The rights and obligations between you and the Company shall be governed by the Terms of Use and applicable announcements of TEASTRUCK. This agreement is construed in accordance with and governed by the laws of the Republic of China (Taiwan). In the event of a dispute, you agree that the Nantou District Court in Taiwan shall be the court of first instance with exclusive jurisdiction.
- General Provisions
Your continued use of TEASTRUCK services indicates that you have read and understood these Terms of Use and agree to act in accordance with them and be bound by them. No adjustments or modifications may be made without the prior written consent of TEASTRUCK. The Company’s failure to act immediately against your or others’ violations does not constitute a waiver of its right to address the consequences of such or similar violations later.
If you act as an agent for a group (including on behalf of your employer), both you and your group shall be jointly and severally liable for the obligations set out herein. If any part of this agreement is found illegal or unenforceable by a court, that part shall be severed, and the remaining parts shall remain valid and enforceable to the maximum extent permitted by law.
